The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner Manish Bhakar S/o Gopal Lal. The petitioner has been arrested in connection with FIR No.414/2023 registered at Police Station Dudu, District Dudu for the offence(s) under Sections 143, 149, 341, 323 and 307 of IPC. Learned counsel for the accused-petitioner submits that the accused-petitioner has been falsely implicated in the case. The injuries No.2 to 4 caused to injured Kanaram were found to be simple blunt in nature and after x-ray of injury No.1, the same also found to be simple in nature. He submits that there is no intention of accused-petitioner to cause injury to injured Kanaram and injuries caused to other injured Dashrath, Mohan Lal and Radhe Shyam were also found to be simple in nature. He further submits that there is no criminal antecedents of the accused-petitioner. In

the FIR, the allegation of assault has been mentioned against the other co-accused. The investigation/trial of the case will take considerable time. Therefore, the benefit of bail should be granted to the accused-petitioner.

Per contra, learned Additional Advocate General vehemently opposes the bail application.

Considering the arguments advanced by the counsel for the parties and looking to the fact that injury No.1 caused to injured Kanaram was found to be simple in nature and other injuries were found to be simple blunt in nature, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Manish Bhakar S/o Gopal Lal in connection with FIR No.414/2023 registered at Police Station Dudu, District Dudu shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
