Apprehending his arrest in connection with FIR No. 269/2022 registered at Police Station Jamwaramgarh, District Jaipur (Rural) for the offence(s) under Section 420, 467, 468, 471, 406 and 120B of IPC, the petitioner has preferred this anticipatory bail application under Section 438 Cr.P.C.

Learned counsel for the accused-petitioner submits that petitioner has falsely been implicated in this case. Learned counsel for the petitioner also submits that the matter between the parties is purely civil in nature and civil suit is already pending before the competent court. The alleged agreement was prepared in the year 2006 and the FIR was lodged in the year 2022, petitioner is an old person aged about 75 years and is bedridden, therefore his anticipatory bail may be allowed.

Learned Public Prosecutor vehemently opposed the bail application.

I have considered the overall allegations leveled in the FIR and the fact that the petitioner is an old person aged about 75 years who is bedridden and the fact that a suit is pending between the parties, therefore, without commenting anything on the merit of the case, I deem it just and proper to allow the anticipatory bail application of the accused-petitioner.

Accordingly, the anticipatory bail application under Section 438 Cr.P.C. is allowed and it is ordered that in the event of arrest of the petitioner -Ladu @ Laduram S/o Late Shri Shyonath , in connection with FIR No. 269/2022 registered at Police Station Jamwaramgarh, District Jaipur (Rural), he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

(iii) that the petitioner shall not leave India without previous permission of the court.
