This bail application has been filed by the accused petitioner in connection with FIR No. 136/2023 registered at Police Station Sarola, District Jhalawar for offence under Section 143, 302 IPC. Later on chargesheet was submitted for offence under Section 304 IPC and Section 3/25 & 5/25 of Arms Act.

Heard learned counsel for the petitioner as well as the Public Prosecutor.

Learned counsel for the petitioner submits that the allegations against the petitioner in the FIR is that he made a gun fire which resulted in the death of the deceased Atma Ram, however, the said gun fire was made because a wild animal was coming towards them and unfortunately that gun shot hit the deceased. He further submits that the petitioner is behind bars since 18.06.2023 and the Police, after investigation, has submitted

chargesheet in the matter. Counsel further submits that the petitioner is no more required for any kind of interrogation and recovery.

Learned Public Prosecutor vehemently opposed the bail application.

Considered the submissions made by learned counsel for the petitioner as well as by the learned Public Prosecutor and also perused the challan papers. 6. Taking into consideration the alleged offence against the petitioner and so also the manner in which the alleging incidence has happened, this Court, without expressing any opinion on merits or demerits of this case, deems just and proper to enlarge the petitioner on bail.

Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided that he furnishes a personal bond in the sum of Rs. 1,00,000/- (Rupees One Lac Only), together with two sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only) to the satisfaction of the Trial Court with the stipulation that he shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
