The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.14/2024 registered at Police Station Banipark, District Jaipur (West) for the offence(s) under Sections 8/20 of the N.D.P.S. Act.

Learned counsel for the petitioner submits that the narcotic contraband recovered in the matter, is below commercial quantity, therefore, the benefit of grant of bail may be granted to the accused-petitioner.

Learned Public Prosecutor vehemently opposes the grant of bail application.

Considering the arguments advanced by the learned counsel for the parties and looking to the overall facts and circumstances

of the case, I deem it just and proper to enlarge the accusedpetitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner- Rajesh Takari S/o Shri Ramesh Takari in connection with FIR No.14/2024 registered at Police Station Banipark, District Jaipur (West), shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
