Instant application has been preferred under Section 482 of the B.N.S.S. 2023 for grant of anticipatory bail to the petitioner, namely Shushila Devi, in a case arising out of First Information Report No.198/2022 registered at Police Station Roopbas District Bharatpur for commission of offence punishable under Section 304-B of Indian Penal Code.

Submissions of learned counsel appearing for the petitioner are that the anticipatory bail application of co-accused, namely Vinod has already been granted by the Co-ordinate Bench of this Court vide its order dated 28.08.2023 on the basis of compromise arrived at between the parties. The petitioner has no criminal antecedents & the parties are willing to settle their dispute amicably. The case of the present petitioner is on same footing of the co-accused petitioner, who has been granted anticipatory bail. Therefore, looking to the facts & circumstances of the case, the anticipatory bail application of the petitioner may be granted.

On the other hand, learned Public Prosecutor appearing for the State has opposed the bail application, whereas the learned counsel appearing for the complainant has submitted that the parties have settled their dispute amicably & he has no objection, if the anticipatory bail application of the petitioner is granted.

Heard. Perused the material made available on record.

Taking into submissions made by the learned counsel appearing for the petitioner as well learned counsel appearing for the complainant and looking to the overall facts & circumstances of the case but without expressing any opinion on the merits & demerits of the case, this Court deems it just & proper to enlarge the petitioner on anticipatory bail.

Accordingly, the anticipatory bail application is allowed and it is, hereby, ordered that in case of arrest of the petitioner, namely Shushila Devi wife of Shri Vijay Singh in the aforesaid F.I.R. by the Investigating Officer, she shall be released on bail provided, she furnishes a personal bond in the sum of Rs.50,000/- together with two sureties in the sum of Rs.25,000/- each to the satisfaction of the concerned S.H.O./I.O. on the following conditions:-

(i) That the petitioner will make herself available for the investigation as and when required by the Investigating Officer;

(ii) That the petitioner will not leave India without prior permission of the Court.

¶22

(iii) That the petitioner will not tamper with the evidence or threaten or pressurize the witnesses in the case.
