period, without having any inimical relation or personal grudge but one unfortunate incident erupted on a very trivial and trifling issue, ultimately reached to the death of Rasheed in that scuffle. The FIR reflects that one Sageer lodged a report at the Police Station Kama, District Bharatpur alleging inter alia that on 23.05.2021 at around 11:00 a.m. both the families of complainant as well as accused were busy in their routine household chores, the daughter of petitioner Hasandeen named Shakeela alleged to have dumped garbage nearby their house upon which the wife of the complainant Sageer objected from doing so, which irked the girl Sakeela and she slapped the complainant’s wife. The matter did not end up here, the complainant Sageer went to the petitioner’s house for rebuking him upon which the petitioner’s wife gave beating by using fits and lathi. Upon raising hue and cry the brother of the complainant named Rasheed along with other family members came there and tried to rescue him, other family members of the petitioner were also gathered there and in this fracas, several members of both the parties inflicted injuries to each other. During the course of affray, it is alleged that the petitioner Hasandeen took a shovel like spade in his hand and inflicted a blow upon Rasheed, the brother of the complainant, which ultimately proved fatal. Thus, a case of murder got lodged against the petitioner and his family members. After investigation, five persons namely Hasandeen, Arshad, Asgar, Akram and Rajudeen were charge-sheeted for committing murder and for forming unlawful assembly etc. Out of these five, three accused persons namely Arsad, Asgar and Akram
