This bail application has been filed by the petitioner under Section 483 of the B.N.S.S. arising out of F.I.R. No.147/2024, registered with the Police Station Sadar Jhunjhunu, District Jhunjhunu for offence under Sections 457 & 380 of IPC.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and he is in custody for about last three months. Counsel further submits that the offences as alleged against the petitioner are triable by the Magistrate. Counsel also submits that co-accused Aman @ Bahadur @ Rocky has already been released on bail by this Court vide order dated 10.09.2024 passed in S.B. Criminal Misc. Bail Application No.11156/2024 and co-accused namely Ankit Chopra, Manisha and Rekha have also been released on bail by this Court vide order dated 04.09.2024 passed in S.B. Criminal Misc. Bail

Application No.10813/2024 with other connected matters, therefore, the present petitioner may be released on bail.

Learned Public Prosecutor appearing for the State opposed the bail application.

Considered the submissions made by learned counsel for the petitioner as well as learned Public Prosecutor.

Having regard to the submissions made by counsel for the petitioner so also the fact that the offences as alleged against the petitioner are triable by the Magistrate and also the fact that coaccused persons have already been released on bail by this Court, this Court without expressing any opinion on merits and demerits of the case, deems just and proper to enlarge the petitioner on bail.

Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before the trial Court or any other Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
