This second bail application has been filed by the accusedpetitioner under Section 483 of B.N.S.S. in connection with FIR No.357/2024 registered at Police Station Kaman, District Deeg for the offences under Sections 379, 411, 419, 420, 467, 468 & 471 of IPC and Section 66D of I.T. (Amendment) Act, 2008.

The First Bail Application No.8217/2024 filed by the accusedpetitioner was dismissed as withdrawn by this Court vide order dated 30.08.2024 with liberty to file fresh bail application after completion of investigation.

Learned counsel for the petitioner submits that the accusedpetitioner has falsely been implicated in this matter. Counsel further submits that the petitioner is in custody since long time; the police after completion of investigation has submitted chargesheet in the matter and he is no more required for any kind of

interrogation or recovery, therefore, the petitioner may be released on bail.

Learned Public Prosecutor has vehemently opposed the second bail application and submits that the accused- petitioner is the prime accused of online fraud. 5. Considered the submissions made by counsel for the petitioner as well as the learned Public Prosecutor. 6. Having regard to the submissions made by learned counsel for the accused-petitioner so also the fact that there is no other criminal case pending against the accused-petitioner, this Court without expressing any opinion on merits and demerits of the case, deems just and proper to enlarge the petitioner on bail.

Accordingly, this second bail application is allowed and it is directed that the accused-petitioner shall be released on bail provided that he furnishes a personal bond in the sum of Rs. 1,00,000/- (Rupees One Lac Only)(each), together with two sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only) each to the satisfaction of the Trial Court with the stipulation that he shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.

It has been brought to the notice of this Court that the accused-persons of particular areas, who are involved in the online fraud, after their release from a criminal case, celebrates their release by public procession. Hence, taking into consideration the aforesaid aspect, a condition is imposed that the accusedpetitioner shall not celebrate his release in public and if he is

found to be involved in celebrating his release in public, the State

shall be at liberty to move the application for cancellation of his bail.
