The instant second bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.02/2023 registered at Police Station Special Police Station, District CID Security for the offence(s) under Sections 3, 5 & 9 of OfÏcial Secrets Act.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the first bail application was dismissed by this Court vide order dated 12.03.2024. It is contended that the petitioner was arrested on 31.03.2023 and since then petitioner is in custody. It is also contended that the matter is still pending in pre-charge evidence and only 4 witnesses have been recorded, out

of cited list of 26 prosecution witnesses, therefore, the second bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor vehemently opposed the bail application and contended that the first bail application of petitioner was dismissed by this Court on merits and thereafter, there is no change in circumstances of the case. It is alleged against the petitioner that he passed secret information to Pakistani handler through a mobile, therefore, considering the gravity of the offence, the second bail application of accusedpetitioner may be dismissed.

Heard and perused the material available on record. 5. Considering the fact that the petitioner was arrested on 31.03.2023. The first bail application was dismissed by this Court on merits vide order dated 12.03.2024 at the stage of pre-charge evidence. It is informed by the counsel for the petitioner that the matter is still pending for pre-charge evidence and only 4 witnesses have been recorded, out of cited list of 26 prosecution witnesses. It is not desirable, at this juncture to express anything on the merits of the case. Taking into consideration that further trial of the case may take considerable time and will not likely to conclude in near future & considering the long incarceration of the petitioner, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the second bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Paru Ram S/o Shri Prema Ram in connection with FIR No.02/2023 registered at Police Station Special Police Station, District CID Security shall be enlarged on bail provided he furnishes a personal

bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
