The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.154/2023, registered at Police Station Jeen Mata, District Sikar for the offence(s) under Sections 3/25(6) of the Arms Act.

Learned counsel for the petitioner submits that the accusedpetitioner has falsely been implicated in this case. The accusedpetitioner is in custody more than six months. Charge-sheet has already been produced before the trial Court, further trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor vehemently opposes the grant of bail application and submits that the petitioner has criminal antecedents and involved in 19 cases, therefore, considering the

criminal antecedents against the petitioner, the bail application may be dismissed.

Heard and perused the factual report.

As per the factual report, charge-sheet has already been produced, the petitioner was arrested on 30.09.2023. The accused-petitioner is in custody since long and trial of the case may take considerable time, therefore, considering the already period by incarceration, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner- Ratan Singh S/o Shri Aashu Singh, in connection with FIR No.154/2023, registered at Police Station Jeen Mata, District Sikar, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
