Instant Criminal Leave to Appeal is preferred by appellantcomplainant, aggrieved from judgment of acquittal dated 14.02.2020 in criminal case No. 26429/2019 passed by learned Metropolitan Magistrate (N.I. Act Cases) No.19, Jaipur Metro.

Learned counsel for respondent-accused submits that respondent-accused is suffering from severe illness and it is not possible for him to attend the proceedings of this Hon’ble Court but he has an instruction to settle this matter. He submits that as a good gesture to settle the dispute the respondent-accused has prepared a demand draft No. 500805 of ₹50,000/- drawn on ICICI Bank dated 10.10.2024 payable to appellant (complainant) is with him and he can hand over this demand draft if the matter is settled by the complainant.

The appellant-complainant is present in person. He is identified by learned counsel for complainant.

Learned counsel for appellant-complainant submits that if ₹1 lac be paid to him over and above ₹1,51,000/- already paid to him in pursuant to order of this Hon’ble Court then he can settle the dispute.

Learned counsels for both the parties agreed to settle dispute between the parties, provided respondent pays ₹1,00,000/- to appellant-complainant. Out of this, ₹50,000/- will be paid by way of demand draft as mentioned hereinabove and remaining ₹50,000/- on future date.

Having considered the submissions demand draft of ₹50,000/- is paid under a receipt to complainant-appellant and remaining ₹50,000/- will be paid within a period of 3 weeks by respondent to the appellant-complainant.

The respondent shall pay Bankers’ cheque or Demand Draft of ₹50,000/- to the counsel for the appelalnt within a period of 3 weeks from now, under intimation to this Court.

With aforesaid the matter stands disposed.
