The matter has come upon miscellaenous application No. 1851/2024 filed under Section 5 of the Limitation Act for condonation of delay in filing the restoration application.

For the reasons & grounds mentioned in the application, the same is allowed. The delay in filing the restoration application is condoned.

The restoration application is taken up for hearing.

The restoration application has been filed seeking recalling of the per-emptory order dated 09.05.2023 passed by Co-ordinate Bench of this Court alongwith subsequent order dated 14.07.2024 passed by Registrar (Judicial) of this Court and restoring S.B. Civil Second Appeal No.398/2010; Babu Lal & Ors. v. Ashok & Ors. to its original number.

For the reasons stated & grounds mentioned in the application, this Court is inclined to allow the application and to restore the original proceedings in S.B. Civil Second Appeal No.398/2010.

Accordingly, the restoration application is allowed. The order dated 09.05.2023 passed by Co-ordinate Bench of this Court alongwith subsequent order dated 14.07.2024 passed by Registrar (Judicial) of this Court, are recalled.
