An application (01/24) has been filed filed by the appellant under Section 5 of the Limitation Act for condoning the delay in filing the restoration application.

For the reasons and grounds mentioned in the application, the application is allowed.

Delay in filing the restoration application is, hereby, condoned.

The present restoration application under Order 41 Rule 19 read with Section 151 CPC has been filed by the petitioner for restoring the Civil First Appeal No.523/2019.

Learned counsel for the petitioner submits that previous counsel did not appear on the dates fixed by the Court so the appeal has been dismissed for non-prosecution vide order dated 27.02.2024 by this Court. Counsel prays that one more opportunity may be given to the appellants for arguing the matter and the civil first appeal may be restored in its original number.
