On 17.01.2021, learned counsel for the petitioners had made a statement before this Court that a settlement has been arrived into between the parties. On that date, learned counsel for the parties prayed for the last opportunity to complete their instructions. However today, none has appeared on behalf of the petitioners.

Learned counsel for the respondents submits that as per his instructions too, a settlement had been arrived into between the parties way back when the auction proceedings were to be finalised. He placed on record, order dated 08.09.2016 passed by the executing court vide which, while rejecting the application as preferred by the applicant, the Court directed for issuance of the notices for auction and directed the auction proceedings to be concluded before 19.01.2017.

In view of the above submissions, nothing survives in the present petition and hence, the same is disposed of .
