Matter has come up on a civil misc. application filed by the applicant-respondent-Man Mohan Dhamu for recalling and modification of order date 29.08.2011 passed by a Co-ordinate Bench of this Court in S.B. Civil Misc. Appeal No.90/2007.

A perusal of order dated 29.08.2011 indicate that while maintaining the interim order, the Co-ordinate Bench of this Court has directed the trial court to dispose of the pending matter within a period of six months.

Heard submissions of learned Senior Advocate appearing for the applicants.

The order which was passed by the Co-ordinate Bench of this Court clearly indicate that after considering the submissions of both the parties, the order was passed. There is no error apparent on record on the basis of which order dated 29.08.2011 can be

recalled or modified. Moreover, this order does not harm any of the party. There is no ground to recall or modify the order dated 29.08.2011, hence, the misc. application is liable to be dismissed and the same is hereby dismissed.

Office is directed to call status report from the trial court about compliance of direction dated 29.08.2011.

In case no compliance is made, then explanation be called and same be listed separately.
