The accused-petitioners have filed this bail application under Section 483 B.N.S.S. arising out of F.I.R. No.194/2024 registered at Police Station Chhipabarod, District Baran for offences under Sections 143, 148, 149, 307 and 323 of IPC.

Considered the submissions made at bar and also perused the challan papers.

On consideration of submissions made by counsel for the petitioners and on perusal of the challan papers, it is revealed that three persons sustained injuries from the complainant’s side and one of the injury sustained by injured Ramesh Chand, has been opined as grievous in nature, however, the said injury is on left

wrist joint by a sharp edged object. It is also come out that accused-petitioners are in custody since 08.10.2024 and police after completion of investigation has submitted the charge-sheet.

It has been brought to the notice of this Court that three members of the accused-party namely, Vinod, Jugraj and Dinesh have also sustained injuries and cross cases have also been lodged by the accused-party against the complainant-party.

Taking into consideration the totality of the facts and circumstances of this case and more particularly the fact that only one injury has been sustained by the complainant-party, which has been opined as grievous in nature and the same is on left wrist joint and also the fact that the petitioners are in custody since 08.10.2024, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the accused-petitioners on bail.

The bail application is, accordingly, allowed and it is directed that accused-petitioners shall be released on bail provided each of them furnish a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that they shall appear before that Court or any other Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
