It is contended by counsel for the applicants that applicants have remained in custody for a period of nine years and

ten months. Disposal of appeal is bound to take time. The first suspension of sentence application was rejected on 17.08.2017. 4. Learned Dy. GA has opposed the second suspension of sentence application. It is contended that there is specific evidence of last seen, recovery of knife, cycle and liquor bottles at the instance of the accused.

We have considered the contentions.

Taking note of the evidence on record and the fact that first suspension of sentence application was rejected, also looking to the statement of PW-2 & 3 and the recovery of knife, cycle and liquor bottles at the instance of the accused, we are not inclined to entertain the second suspension of sentence application and the same is accordingly, dismissed.

However, looking to the custody period of the accused, appeal be listed for hearing on 21.08.2023.
