Accused-appellant has preferred this second application for suspension of sentence.

Heard on second application for suspension of sentence.

It is contended by counsel for the appellant that appellant has remained in custody for a period of four years and ten months. It is also contended that initially police filed charge-sheet under Section 306 of IPC and POCSO Act.

Learned Additional Advocate General and counsel for the complainant have opposed the second application for suspension of sentence. It is contended that first application for suspension of

sentence was dismissed on merits. There is no change in circumstances and accused has been convicted for offence under Sections 302 and 376 of IPC.

We have considered the contentions.

Taking note of the fact that earlier application for suspension of sentence was decided by the Court on merits, we are not inclined to entertain the second application for suspension of sentence.

Criminal Misc. Second Suspension of Sentence Application is accordingly, dismissed.

Taking note of the custody period, list the appeal for hearing on 10.10.2023.
