This appeal is argued on the ground that though Rule 25 of the RIICO Disposal of Land Rules, 1979 was pressed into service, learned Single Judge despite rule having been referred, did not

refer to the said Rule and the provisions contained therein while deciding the issue.

The ground which is now being raised that despite rule having been referred to, learned Single Judge did not look into the rules, can be raised only by filing review petition and not in the appeal. Therefore, the appeal is dismissed with liberty to file the review petition on the aforesaid grounds.
