In view of the above, this special appeal is dismissed as having become infructuous.
Needless to say that the Commissioner shall not be influenced by any of the observations made by the learned Single Judge in the impugned order and shall consider and decide the appeal filed on behalf of the appellants on merits strictly in accordance with law.
