Petitioner has preferred this habeas corpus petition seeking production of the corpuses, who happen to be maternal-grandchildren of the petitioner.

We have perused the record.

From perusal of the record, it is revealed that petitioner had earlier filed applications under Section 97 Cr.P.C. & 98 Cr.P.C.,

wherein, the corpuses were called before the Court. The Court individually examined both the children and the order was passed in presence of the petitioner and her counsel and the Court observed that corpuses are not in any illegal detention.

Since, judicial order has been passed, wherein, the Court has come to the conclusion that corpuses are not in any illegal detention, we are not inclined to entertain the present habeas corpus petition.

The present Habeas Corpus Petition is accordingly, dismissed.

The contention of the counsel for the petitioner that under the Hanafi law, after demise of the married daughter, the maternal-grand-mother has right over the child of her daughter, can be raised before the Competent Court.
