Matter comes up on misc. application No.1/2022 filed by the petitioner to decide the present writ petition in the light of the judgment passed by the co-ordinate Bench of this Court in S.B.Civil Writ Petition No.5926/2022 (State of Rajasthan & Anr. Vs. Krishna Kumar & Anr.) decided on 27.09.2022.

Learned counsel for the petitioner submitted that in the instant case, the petitioner has prayed for granting him promotion on the post of Head Constable and further promotion from the date of recommendation made by the respondents.

Learned counsel appearing for the respondents submitted that the order passed by the Co-ordinate Bench of this Court in the case of State of Rajasthan & Anr. Vs. Krishna Kumar & Anr. (supra) is being implemented by the State Government and as such a High Level Committee of three members has already been constituted and as such learned counsel for the respondent places a letter dated 18.01.2023 for perusal of this Court and submits that all the cases are now being taken up as per the directions given by this Court and accordingly case of the petitioner will be taken up along-with other cases.

This Court finds that the co-ordinate Bench of this Court in the case of Rajasthan & Anr. Vs. Krishna Kumar & Anr. (supra) has already considered the controversy and as such the directions, which have been given in the aforesaid cases, will also be applicable in the present case as well.

This goes without saying that if the respondents have constituted a Committee for implementing the order passed by this Court for examining the cases, the cases of other candidates, including the petitioner, will also be taken up.

This Court accordingly disposed of the present writ petition in view of the order passed by this Court in the case of Rajasthan & Anr. Vs. Krishna Kumar & Anr. (supra).
