The present writ petition has been filed for the following relief:

“It is, therefore, respectfully prayed that this writ petition may kindly be allowed and by an appropriate writ, order or direction:-

(a) The respondents may be directed to allow the permit the petitioner to enhance the seats in B.Sc. Nursing Course from 40 students to 50 students for the academic session 2021-222;

(ii) The respondents authorities may kindly be directed to inspect the petitioner institute and a further direction may be granted to do the needful within a period of 3 months.

Learned counsel for the petitioner submits that vide order dated 02.03.2023 no objection certificate has been issued in favour of the petitioner for 50 seats in B.Sc. Nursing Course. The order dated 02.03.2023 is taken on record.

In view of the order dated 02.03.2023, the relief prayed for in the instant writ petition has already been granted and the writ petition has become infructuous.

Accordingly, the present writ petition is dismissed as having become infructuous.

¶26

However, it is made clear that on the strength of the order dated 02.03.2023 passed by the respondents, the petitioner will be eligible to participate in the forthcoming counseling for the academic session 2022-23 with an annual intake capacity of 50 seats.
