the considered view that there is no legal prohibition operating in law against the petitioner from exiting Government Medical College, Kota and getting admission into AIIMS Raipur. He is only to pay the bond of Rs.5 lacs as per the conditions set out in the instructions to candidates in the information booklet issued by NEET (UG) Medical and Dental Admission/Counseling Board, 2018. The submission of Mr.S.K. Gupta, AAG based on the condition that “no candidate will be allowed to resign from the State quota seat after the second round of counseling” is of little avail primarily for reason of the ambiguity of the clause and it seriously being open to unconstitutionally if it were to be read as submitted to entail a prohibition for a student to exit the admission no matter what the circumstance having a bearing on his career as a professional in the long run. Contrarily in terms of conditions of the instruction in the information booklet in issue a candidate is allowed leave the MBBS course, before its completion subject to forfeiture of Rs.5 lacs, in terms of the bond for the amount executed at the time of admission. The petitioner has been admitted to the Government Medical College, Kota on executing a bond of Rs.5 lacs. The only legal consequence of his exiting course in that college will the forfeiture of the bond of Rs.5 lacs. Counsel for the petitioner stated that the sum under bond of Rs.5 lacs will be paid by a demand draft to the respondentGovernment Medical College, Kota today itself as the documents submitted to the said college are required by the petitioner to report to AIIMS, Raipur by tomorrow i.e. 25.08.2018. In view of above, I would be inclined to allow this petition and direct the respondentGovernment Medical College, Kota that on receipt of a demand draft of Rs.5 lacs from the petitioner, his original documents be released forthwith today itself.
