The petitioner has challenged the action of respondents of not deciding her representation filed against not including her in the REET-2021 on the ground that she acquired diploma in elementary education in the year 2020 simultaneously, she acquired B.Sc B.Ed degree in 2019.

Counsel for petitioner has relied upon an order of this court dated 04.02.2023 in S.B.C.W.P No. 997/2023, Ranjeet Kumar Damor v. State of Rajasthan , wherein this court relying upon

Kuldeep Kumar Pathak v. State of U.P. [AIR (2016) SC 251] , held that there is no prohibition from taking simultaneous degree and diploma and respondents were directed to decide representation in favor of the petitioner.

In view of observation of this court in case of Ranjeet Kumar Damor (supra) , respondents are directed to decide the representation of the petitioner taking into consideration the observation of the Apex Court in case of Kuldeep Kumar Pathak
