Petitioner, present in person, states that he has preferred an appeal No.945/2023 before the Rajasthan Civil Services Appellate Tribunal, Jaipur (hereafter referred to “the Tribunal”) assailing the transfer order dated 11.02.2023 as well as relieving order dated 13.02.2023 on legal and factual grounds. He states that the appeal was listed before the Tribunal on 28.02.2023 and he appeared in person, but due to non-appearance of advocate on behalf of respondents, he was not heard on appeal and stay application and Tribunal deferred the hearing of appeal for 14.03.2023.

Petitioner pointed out that now-a-days, since advocates are abstaining from giving appearance in courts, therefore, in absence of appearance of counsel for respondents, the Tribunal deferred the hearing of appeal. Petitioner submits that in such circumstances, he may be heard in person and appropriate orders against the impugned transfer order dated 11.02.2023 be passed.

Taking into consideration aforesaid facts/situation, this Court is of opinion that when statutory appeal against the transfer order of petitioner is pending before the Tribunal, and next date is fixed for 14.03.2023, therefore, the petitioner is at liberty to appear in person before the Tribunal on the next date of hearing. If petitioner appears in person, then the Tribunal shall provide hearing to the petitioner on his appeal/stay application and would pass appropriate orders irrespective of fact that respondents put in appearance or not.

With aforesaid directions, the writ petition stands disposed of.

Stay application and any other pending application, if any, stand disposed of.
