Mr. Manoj Bhandari, learned Senior Counsel assisted by Mr. Govind Suthar appearing on behalf of the petitioner submits that they are prepared to avail the Amensty Scheme, which is in vogue uptil 30.12.2023 vide office order (13/2023) dated 27.09.2023 and the petitioner may be permitted to approach the respondents to avail the benefit for the plot in question. He further submits that the consideration may be made in accordance with Amensty Scheme and the RIICO Disposal of Land Rules, 1979 particularly, Rule 23-D(1).

Learned counsel for the respondents submits that a consideration under the prevailing law shall be made strictly in accordance with law while keeping into consideration the submission made by learned Senior Counsel.

In view of the above, the instant petition is disposed of with a direction to the respondents to decide the issue of restoration of the allotment of the plot, strictly in accordance with law while keeping into consideration the prevailing laws as well as the Rules of 1979.

The petitioner shall move fresh application for availing the Amensty Scheme within a period of 15 days from today and the respondents shall decide the same by passing a speaking order within a period of 30 days from thereafter, strictly in accordance with law.

All pending applications also stand disposed of.
