Learned counsel for the petitioner submits that while the Annexure-2, which is the birth certificate, which has been cancelled by the competent authority vide Annexure-5, the only valid certificate is Annexure-1, which was issued earlier on 28.02.2004 and which carries a date of birth of 15.12.2003.

Learned counsel for the petitioner seeks that since it was the original certificate and inadvertently, the parents committed a mistake of getting a fresh certificate issued, which has been got while realizing their mistake, the petitioner should be given the benefit of change to Annexure-1.

In light of such submissions, the present petition is disposed of with a direction to the petitioner to appear before the

respondent No.2 with the original certificate (Annexure-1), the cancelled certificate original (Annexure-2) and cancellation order (Annexure-5) shall be taken in original by the petitioner before the respondent No.2, who after examining the veracity of such documents, shall take appropriate action for necessary change in the certificate in question, strictly in accordance with law. All pending applications stand disposed of.
