Heard counsel for the parties.

On 06.02.2023, this Court passed the following order:-

“Counsel for the petitioner submits that against the order of recovery dated 30.11.2022 passed by the respondents, the petitioner has filed an appeal before the Central Government Industrial Tribunal-cum-Labour Court, Jaipur, which is still pending. Counsel further submits that the Presiding Officer of the said Tribunal has not been appointed as yet and prayed for stay of recovery proceedings during pendency of appeal.

In that view of the matter, issue notice to the respondents, returnable by six weeks.

Meanwhile, recovery proceedings initiated against the petitioner in pursuance of the order dated 30.11.2022 passed by the respondents shall remain stayed.”

Counsel for the respondents submits that the Presiding

Officer of the Tribunal has already been appointed and joined, therefore, the Tribunal is functioning regularly.

In that view of the matter, I dispose of this writ petition with the liberty to the petitioner to pursue its appeal before the Tribunal.

The pending applications if any, stands disposed of.
