The matter comes up on an application, filed on behalf of the respondents, for taking additional facts and documents on record for disposal of the writ petition.

Learned counsel Ms.Shruti Singh, appearing on behalf of leaned counsel Ms.Manju Joshi, submitted that learned counsel Ms.Manju Joshi is no more the counsel for the Union of India.

This Court finds that the petitioner, in the instant writ petition, challenged the order dated 27^th August, 2018, whereby the order for recovery was issued against the petitioner.

I have gone through the application, filed by the respondents and the document, i.e. letter dated 19^th September, 2019, issued by the Ministry of Defence, Government of India, which has been placed on record, whereby the notional fixation of pension w.e.f. 01^st January, 2006, in respect of NCC WTO has been done at par with regular army officers of equivalent rank.

I have also considered the averments made in para No.4 of the application, whereby the respondents have admitted that the petitioner was entitled for revised pension and bank scroll of the petitioner has also been annexed, revising pension of the petitioner.

This Court finds that the orders at Annexure - 1 and Annexure – 2, enclosed along with the application by the respondents, now grant relief, which has been sought by the petitioner in the instant writ petition.

In view of the above, the present writ petition does not require any adjudication on merits.

¶26

Accordingly, this Court disposes of the writ petition as having become infructuous, in view of the subsequent development, which has been taken place, granting relief to the petitioner.
