The grievance as ventilated through this P.I.L. is with regard to inadequate facilities of access to road.

Though there is a prayer for changing the alignment of proposed road i.e. State Highway No.26-A (Beawer to Goyla via Masuda & Bandanwada), learned counsel for the petitioner submits that he is not pressing the appeal but a direction may be

issued for ensuring proper access to road for residents of Tehsil Bhinai to Kekri which has been now declared as new district.

Learned counsel for the petitioner does not say that there is no access, however, the grievance of the petitioner appears to be that the proper road conditions are not there which create problem for commutation.

The petitioner has stated on affidavit that representation was made to the authorities, but no authority is looking into the matter and the grievance with regard to bad condition of road is not being addressed to, therefore, this P.I.L. had to be filed.

As the petitioner has already preferred representation, taking into consideration that providing access, construction of roads, maintenance of roads is obligation of Public Works Department, the Superintending Engineer, Public Works Department, Ajmer Circle, Ajmer—Respondent No.2 shall examine the complaint/representation and take necessary steps in the matter. Except this, we are not inclined to pass any other order.

The petition is accordingly disposed off.
