The matter has come up on an application No.1/2023 filed by the petitioner seeking direction in respect of grant of Child Care Leave.

The petitioner states that in the present writ petition, this Court vide order dated 30.01.2023 directed respondents to consider the case of petitioner for grant of Child Care Leave according to the eligibility criteria.

It has been stated that the petitioner applied for Child Care Leave from 01.02.2023 to 01.04.2023 for care of her disabled child and preparation to Class 12^th Board Examination. She states that as per the Notification dated 22.05.2018, she is entitled for Child Care Leave for a period of 120 days as per Rule 103-C (2) (ii) of Rajasthan Service Rules,1951. However, respondents vide order dated 13.02.2023 have accorded CCL only for 15 days and no specific reason has been assigned for not granting leave upto 01.04.2023. The copy of the order dated 13.02.2023 has been placed on record as Ann.A, which is taken on record.

No reply to the application has been filed by respondents.

In the order dated 13.02.2023, respondents neither have assigned any reason to accord Child Care Leave only for 15 days to petitioner nor any reason has been given for not sanctioning the Child Care Leave as prayed by petitioner. As per Circular dated 22.05.2018, the petitioner is entitled for 120 Child Care Leave, therefore, respondents are directed to extend the Child Care Leave of the petitioner upto 01.04.2023 as she has prayed.

Accordingly, the applications No.1/2023 and No.2/2023 stand disposed of.
