The present writ petition has been filed by the petitioner seeking direction to the respondent to change the petitioner’s name as ‘Siddhant Choudhary’ in place of ‘Shobha Ram Jat’ according to Gazette Notification dated 08.02.2018 in the marksheets and Board Certificates of 10^th and 12^th Class issued by the Rajasthan Board of Secondary Education.

The petitioner who is present in person before the Court submits that in the documents of Board of Secondary Education in Secondary School Examination held in 2007 and Senior Secondary Examination held in 2009, petitioner’s name has been recorded as ‘Shobha Ram Jat’. Counsel also submits that in view of his wish, his name be changed from ‘Shobha Ram Jat’ to ‘Siddhant

Choudhary’, as Gazette Notification dated 08.02.2018 was got issued after following the due process, prescribed under law.

The petitioner submits that the respondent may be directed to change the petitioner’s name from ‘Shobha Ram Jat’ to ‘Siddhant Choudhary’, in the documents as per Gazette Notification dated 08.02.2018 and no prejudice can be caused to the respondent in doing so.

Counsel for the respondent-Board submits that the Hon’ble Supreme Court in case of “Jigya Yadav (Monor) Through Guardian/Father Hari singh Vs. C.B.S.E. (Central Board of Secondary Education) and Ors.”, reported in AIR 2021 Supreme Court 4775 has made some observations in regard to the change of name and other entries in the documents of educational qualification. Counsel further submits that though the application filed by the petitioner for change of name was disposed, however, in case, the petitioner submits a fresh application, the respondent-Board is ready to consider the same, in light of the observations made by the Hon’ble Supreme Court in case of Jigya Yadav (supra).

In view of the submissions made by the petitioner and the statement made by counsel for the respondent, this Court feels that the ends of justice would meet if the petitioner is permitted to make a fresh application to the respondent-Board for changing his name in the relevant documents. 6. In view of the above, this Court deems it just and proper to dispose of the present writ petition with liberty to the petitioner to move a fresh and appropriate application before the respondentBoard and it is expected from the respondent-Board that they will

consider the application filed by the petitioner and decide the same expeditiously by a reasoned and speaking order.

Since the main petition has been disposed, stay application and all other applications, if any, also stand disposed.
