Instant petition has been filed by the petitioner with the

following prayer:

“(i) Issue a writ order or direction in the nature thereof thereby quash and set aside the order by which respondent no.1 denied to take interview of the petitioner.

(ii) Issue a writ order or direction in the nature thereof thereby, one opportunity may kindly be given given to the petitioner for interview.

iii) Any other order or direction which the Hon’ble Court deems fit and proper may kindly be passed in favour of the petitioner.

(iv) Cost of the writ petition be also awarded in favour of the petitioner.”

By way of filing instant petition, the petitioner is seeking directions against the respondents to call him for interview and thereafter consider his case for appointment on the post of Assistant Accountant. Contents of the petition indicates that the petitioner received the call letter after the date of interview because of fault of the Post Office, hence the petitioner has been deprived to participate in the process for selection.

At the outset, learned counsel for the respondents apprised this Court that the entire recruitment process arising out of the advertisement dated 10.05.2010 has been completed long back and all advertised posts have been filled and no posts are lying vacant. Counsel submits that under the changed circumstances, this petition has become infructuous.

Heard and considered the submissions made at the Bar and perused the material available on the record.

Considering the arguments put forward by the learned counsel for the respondents and looking to the fact that the entire recruitment process arising out of the advertisement in question has been completed long back and all advertised posts have been filled and no posts are lying vacant. Hence, at this belated stage, no relief can be granted to the petitioner.

The writ petition is dismissed accordingly. Stay application and all applications (pending, if any) also stand dismissed.

However, the petitioner would be at liberty to move before the appropriate forum of law against the Postal Department for claiming adequate amount of compensation.
