It is submitted by learned counsel for the petitioner that the respondent – Para Medical Council has refused to accept the application form of the petitioner seeking registration with the said Council.

Submissions have been made that the petitioner fulfills all the requisites for getting registered with the said Council, however, even the application has not been accepted by the respondents, which action of the respondents is not justified.

I have considered the submissions made by learned counsel for the petitioner and have perused the material available on record.

The representation made by the petitioner Annex.3 dated 18.11.2022 is specific, wherein, the petitioner has required the

Registrar to accept the application, which shows that the same is not being accepted.

The Para Medical Council cannot refuse to accept an application form, it is incumbent for it to receive the application. In case, it finds that the applicant is not eligible to be registered, it can always reject the application, however, the refusal, even to receive the application, cannot be countenanced.

Consequently, the petition filed by the petitioner is disposed of. The respondent No.2 – Para Medical Council, Jaipur is directed to accept the application form of the petitioner and pass appropriate orders pertaining to registration in accordance with law.
