Petitioner through her son has preferred this writ petition (parole) stating therein that petitioner was granted third regular parole by the Authorities, however, while granting parole they imposed condition of furnishing of two sureties of Rs.50,000/each.

It is contended by counsel for the petitioner that petitioner is a poor lady, who is not having any financial resources. It is also contended that petitioner earlier also was given benefit of parole by waving condition of furnishing of sureties.

Report was sought from the State with regard to financial status of the petitioner. Report was submitted wherein it is mentioned that the financial status of the petitioner is not good. State has also submitted that petitioner availed first and second parole and thereafter surrendered in due time.

We have considered contentions.

Taking note of the fact that the parole was granted to the petitioner on 05.07.2022 by the Authorities; also the fact that as per the financial status report, petitioner is a poor female, who is not having sufficient means to furnish sureties, also the fact that petitioner earlier availed first and second parole only on personal bond and surrendered in due time, we deem it proper to waive the condition of furnishing of two sureties. Accordingly, the condition of furnishing of two sureties is waived and petitioner be given benefit of parole as per order dated 05.07.2022 only on his submitting personal bond of Rs.1,00,000/-.

Criminal Writ Petition (Parole) is accordingly, allowed.
