This Criminal Parole Petition is filed by the petitioner being aggrieved with the action of the respondents of lodging him in the Central Jail, Jodhpur instead of the Open Air Camp, Mandore, Jodhpur pursuance to the order dated 16.09.2022 passed by the Director (Prisons), Rajasthan Jaipur.
Learned counsel for the petitioner has submitted that though, order dated 16.9.2022, the petitioner was transferred to the Open Air Camp, Mandore, Jodhpur, but since the petitioner is the resident of Jodhpur itself, he cannot be lodged in the Open Air

Camp, Jodhpur in view of the MOU executed between the Jail Authorities and the Agricultural Research Station (Agriculture University Jodhpur).
Learned AAG has submitted that in view of the above fact situation, now the transfer of the petitioner to the Open Air Camp, Mandore, Jodhpur is cancelled and he has been transferred to the Open Air Camp, Sikar.
Learned counsel for the petitioner has submitted that Sikar is too far and the petitioner can be accommodated in any of the Open Air Jails situated at Jalore or Barmer.
In response to the above submission made by learned counsel for the petitioner, learned AAG has submitted that the prisoners are being accommodated as per the vacancies available and in future, if any vacancy arises in the Open Air Jail, Jalore or Barmer, the petitioner may file an appropriate application in this regard and the same will be considered in accordance with law.
In view of the assurance given by learned AAG, no further order is required to be passed in this Criminal Parole Petition, which is disposed of as such.
