This criminal writ petition is filed by the petitioner being aggrieved with the condition imposed by the Distt. Parole Committee, Bikaner (for short ‘the Committee’) dated 25.8.2023, whereby the petitioner was released on 40 days’ third parole subject to the condition that he shall furnish a personal bond of Rs.2,00,000/- along with two sureties of Rs.1,00,000/- each (duly verified by Tehsildar).

Learned counsel for the petitioner has submitted that this Court in DB Criminal Writ Petition No.64/2021 decided on 22.2.2021 has allowed the petitioner to avail second parole of 30

days on furnishing a personal bond of Rs.1,00,000/- along with one surety of a local person (duly verified by Tehsildar) in the likewise amount to the satisfaction of the Superintendent, Central Jail, Bikaner.

Learned counsel for the petitioner has submitted that the petitioner is ready to furnish one surety of Rs.1,00,000/- along with personal bond of Rs.1,00,000/- for availing 40 days’ third parole.

Learned AAG has opposed this criminal writ petition.

Having heard learned counsel for the parties and taking into consideration the fact that earlier also this Court has allowed the petitioner to avail second parole of 30 days on furnishing personal bond of Rs.1,00,000/- along with one surety of a local person (duly verified by Tehsildar) in the like amount, we allow this criminal parole petition and direct the respondents to release the petitioner on 40 days’ third parole on furnishing a personal bond of Rs.1,00,000/- along with one surety of a local person (duly verified by Tehsildar) in the likewise amount in terms of the decision of the Committee dated 25.8.2023.

The petitioner is directed to surrender before the jail authorities concerned on expiry of the parole period.
