The instant parole petition has been filed on behalf of the convict Seva Ram S/o Satyanarayan Salvi for grant of first regular parole of 20 days.

Heard.

It is submitted by learned counsel for the convict-petitioner that the Superintendent, Central Jail, Udaipur and Social Justice and Empowerment Department have recommended to release the convict on parole, however, the District Parole Advisory Committee has refused to release the convict on first regular parole of 20 days on the ground that if the petitioner is released on parole, there is possibility of breach of peace and happening of untoward

incident. It is further submitted that the convict has already served out more than five years of sentence and the decision of the Parole Committee is unjust, therefore, regular parole of 20 days may be granted to the convict Seva Ram S/o Satyanarayan Salvi.

A reply to the petition has been filed on behalf of the respondents-State justifying refusal of parole to the convict on the basis of report of the Superintendent of Police, Chittorgarh. 5. It is submitted by learned counsel for the State that the Superintendent of Police, Chittorgarh has opined not to release the convict on parole on the ground that if the prisoner will be released on parole, there is possibility of happening of unpleasant incident, therefore, the Parole Committee was justified in refusing to release the convict on parole and the parole petition filed on behalf of convict Seva Ram S/o Satyanarayan Salvi may be dismissed .

I have considered the arguments advanced before me and perused the material available on record. 6. Considering the fact that the convict Seva Ram is inside the Jail for about last more than five years and there is no justified ground for refusal of parole by the Parole Committee, in such circumstances, I deem it appropriate to grant first parole of 20 days’ to convict Seva Ram .

Consequently, the instant parole petition is allowed and it is directed that the petitioner-convict Seva Ram S/o Satyanarayan Salvi may be released on first parole of 20 days upon furnishing his personal bond of Rs.1,00,000/- along with two sureties of Rs.50,000/- each to the satisfaction of the

Superintendent of Central Jail, Udaipur and he shall surrender before the Superintendent of Central Jail, Udaipur after availing 20 days first parole from the date of his release.
