This petition has been sent by post by the petitioner seeking relaxation of condition imposed by the Committee while permitting him 6^th parole of 40 days on furnishing two sureties of Rs.25,000/each and personal bond of Rs.50,000/-.

Submissions have been made that the petitioner is not in a position to furnish sureties and that in the past, by order dated 10.2.2022 passed by this Court in D.B. Criminal Writ No.26/2022, he was ordered to be released on furnishing a personal bond of Rs.50,000/-.

Submissions have been made that whenever he was sent on parole, he has followed the conditions of parole and, therefore, he may be permitted to go on 6^th parole on personal bond only.

A response has been filed inter alia indicating that the petitioner on three occasions in the post, after furnishing sureties, has gone on parole, however, it is not denied that by order dated 10.2.2022 passed in D.B. Criminal Writ No.26/2022, he was permitted to go on parole on personal bond.

In view of the above fact situation, wherein, the petitioner is already lodged in the Open Air Camp and on the last occasion, when he was granted parole on furnishing sureties, this Court relaxed the same, the petition filed by the petitioner is allowed. The petitioner- Jakir Hussain S/o Abdul Karim @ Babu Kha, shall be released on 6^th parole of forty days from the date of release upon furnishing personal bond in the sum of Rs.50,000/- only to the satisfaction of Superintendent, Central Jail, Barmer. The condition of furnishing two surety bonds is waived. The other conditions of order dated 25.4.2023 are maintained.
