Petitioner has filed this bail application under Section 439 of Cr.P.C.

F.I.R. No.206/2023 was registered at Police Station Raini, District Alwar for offences under Sections 498-A & 306 of IPC

It is submitted by counsel for the petitioner that petitioner has falsely been implicated in this case. He further submits that initially, a report was submitted by complainant to SHO Baswa, District Dausa wherein no allegation was levelled against the petitioner. Present FIR was lodged after eight days wherein allegation for harassment of deceased was levelled against her inlaws. He further submits that petitioner is in custody. Chargesheet has been filed and trial is likely to consume time. Further custody of the petitioner is not warranted for any fruitful purpose.

Learned Public Prosecutor assisted by learned counsel for the complainant has opposed the bail application.

I have considered the contentions.

Having regard to the totality of the facts and circumstances; considering the arguments advanced by learned counsel for both the parties and the fact that in the first instance, a report was submitted by the complainant wherein no allegation of harassment was levelled and the matter was reported to the police after eight days wherein allegation of harassment has been levelled, but without expressing any opinion on merits/demerits of this case, this Court deems it just and proper to enlarge the petitioner on bail.

This bail application is accordingly allowed and it is directed that accused petitioner- Santosh Kumar Prajapat S/o Shri Vishram Prajapat, shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
