alleged that on 06.03.2023 in broad day light at 2.00 P.M. when she was going to fetch milk from the nearby street and when she reached near house of the petitioner, the accused met there and took her to into his house and it is alleged that she was taken in one room where she was subjected to rape. She was examined under Sections 161 thereafter before the Magistrate under Sections 164 Cr.P.C. on 14.03.2023. Though, at the stage of hearing on the point of bail, no comments are required to be made on the quality of prosecution evidence but at the same time, the facts necessary for showing inclination of the Court for granting bail would be required to be incorporated. The prosecutrix is aged about twenty three years. The incident was allegedly committed in broad day light. There is significant discrepancies in between the FIR and 161 Cr.P.C. even in her statement recorded under Section 164 Cr.P.C.. Considering the overall facts and circumstances of the case, after arrest, charge-sheet has been filed, I deem it proper to allow the petitioner to be enlarged on bail.
