The present bail application has been filed under Section 438 Cr.P.C. in connection with FIR No. 25/2023 registered at Police Station Sadar Karauli, District Karauli for the offence(s) under Sections 143, 323, 341 325, 427 & 308 of IPC.

Heard learned counsel for the parties.

Considering the arguments advanced by both the sides, considering that co-accused have been enlarged on regular bail; that applicant was granted interim protection from arrest vide order dated 28.06.2023 which has continued till date, and looking to the overall facts and circumstances of the case and material on record, but without commenting on merits/demerits of the case, this Court is inclined to make the interim order dated 28.06.2023 absolute, in view of the Hon’ble Supreme Court judgment of

Abhishek Kumar vs State of Delhi: (2022) 6 SCC 399 and Dheeraj Bhadviya vs. State of Rajasthan: (2022) 6 SCC 63 .

Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Sadar Karauli, District Karauli in F.I.R. No. 25/2023 is directed that in the event of arrest of the accused-applicant- Shivkailash Meena S/o Mangilal Meena , he/she shall be released on bail, provided he/she furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

¶23

(iii) that the petitioner shall not leave India without previous permission of the court.
