Learned Public Prosecutor was directed to inform the complainant about filing of this case through S.H.O. concerned, vide order dated 18.01.2023.

Report dated 29.01.2023 of the S.H.O. Police Station Ajeetgarh, District Sikar with regard to effect service on the complainant has been filed.

After perusal of the said report, the complainant has been served and as per the office report, dated 02.02.2023, service is complete.

The present bail application under Section 439 Cr.P.C. has been filed by the petitioner in connection with F.I.R. No.253/2021, registered at Police Station Ajeetgarh, District Sikar for the offence under Sections 363 IPC; 84 of Juvenile Justice (Care and Protection of Children) Act, 2015 and 3(2)(va) of SC/ST (Prevention of Atrocities) Act, 1989 (Amendment 2015).

Learned counsel for the petitioner submits that the petitioner is in custody since 22.10.2022 and he has been falsely implicated in this case.

Learned counsel for the petitioner submits that the allegation of rape has not been levelled against the present petitioner.

Learned counsel for the petitioner submits that the trial of the case will take its considerable time and charge-sheet has also been filed in this case.

Learned counsel for the petitioner further submits that the co-accused Ramjati Choudhary has been enlarged on bail by Coordinate Bench of this Court in S.B. Criminal Misc. Bail Application No.16965/2022, vide order dated 10.01.2023 as well as co-accused Rinku Kumar has also been granted bail by the trial court, vide its order dated 10.11.2022, hence, he prays that the petitioner may be enlarged on bail.

Learned Public Prosecutor has opposed the bail application.

I have heard the submissions made by learned counsel for the parties and perused the material available on record.

Taking into consideration the facts and circumstances of the case and in view of the fact that the petitioner is in custody since long i.e. 22.10.2022; co-accused Ramjati Choudhary & Rinku Kumar have already been enlarged on bail; charge-sheet has also

been filed under Sections 363, 366A, 368/120B IPC; 16/17 of POCSO Act and 3(2)(v), 3(2)(va) of SC/ST Act & 84 of the JJ Act and trial will take its own time, without commenting any opinion on the merits & demerits of the case, this Court deems it just and proper to release the accused-petitioner on bail.

Accordingly, the present bail application filed under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Ramveer Singh Choudhary S/o Shri Kishore Choudhary , arrested in connection with the aforementioned FIR, shall be released on bail, provided, he furnishes a personal bond in the sum of Rs.50,000/-along with two sureties in the sum of Rs.25,000/- each, to the satisfaction of the learned Trial Court for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
