This application for bail has been filed by the petitioner under Section 439 of the Cr.P.C. in connection with FIR No.493/2022, Police Station Mahaveer Nagar, Kota City for the offence under Section(s) 376 & 506 IPC and later on for the offence under Section(s) 376(2)(N) & 506 IPC.

Learned counsel for the petitioner has contended that accused-petitioner is an innocent person and has falsely been implicated in this case. He further submits that a compromise has already been arrived at between the parties. It has also been contended that prosecutrix, personally present in Court along with her Advocate Mr. Devanshu Sharma has admitted that she has arrived at compromise with the present accused-petitioner. It has also been contended that accused-petitioner is behind bars since

25.11.2022, trial of the case will take time hence, the petitioner be enlarged on bail.

Heard learned counsel for the petitioner and learned Public Prosecutor and also perused the material available on record.

Learned Public Prosecutor has vehemently opposed this bail application.

Having regard to the facts and circumstances of the case and the fact that parties have arrived at a compromise; but, without expressing any opinion on the merits/demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.

Consequently, the bail application filed under Section 439 Cr.P.C. is allowed. It is ordered that petitioner Mahesh S/o Lt. Shri Brijmohan , arrested in connection with FIR No.493/2022, Police Station Mahaveer Nagar, Kota City shall be released on bail; provided he executes personal bond in the sum of Rs.50,000/and two sureties of Rs.25,000/- each to the satisfaction of the learned trial Court. Petitioner shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
