The petitioners have been arrested in connection with FIR No.358/2022 of Police Station – Govardhanvilas, District Udaipur for the offences punishable under Sections 302, 201, 411, 414 & 120-B of IPC . They have preferred these bail applications under Section 439 Cr.P.C.

Learned counsel for the petitioner has submitted that the petitioners have falsely been implicated in this present case. It is submitted that the allegations against the petitioners are only to the extent that they have sold the offending vehicle. It is further submitted that the petitioners were not present at the place of occurrence of offence. Further, it is submitted that the allegations of causing death of deceased are against Kuldeep Singh, Kishan Lal @ Sunny and Kanhaiya Lal. The accused-petitioner s are in custody since long and the trial of the case will take long time. Therefore, the benefit of bail should be granted to the accusedpetitioners.

Learned Public Prosecutor has vehemently opposed the bail applications. However, Learned Public Prosecutor as well as the Investigating Officer, present-in-person, are not in a position to dispute the fact that the present petitioners are the sellers of the offending vehicle. 4) Having regard to the totality of the facts and circumstances of the case and after perusing the page Nos.23, 67, 71 of the paperbook (Charge-sheet), without expressing any opinion on the merits of the case, this Court is of the opinion that the bail application filed by the petitioners deserves to be accepted. 5) Accordingly, the bail applications filed under Section 439 Cr.P.C. are allowed and it is directed that petitioners - (1) Manish S/o Kana (2) Latha Anil @ Anka S/o Rajnikant shall be released on bail in connection with FIR No.358/2022 of Police Station – Govardhanvilas, District Udaipur, provided they execute a personal bond in a sum of Rs.1,00,000/- each with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned
