This instant anticipatory bail application has been filed by the petitioner apprehending his arrest in connection with FIR No.95/2021, Police Station Kumher, District Bharatpur for the offences under Sections 420, 406, 467, 468 and 120B IPC.

Learned counsel for the petitioner submits that for the alleged incident occurred in the year 2013 a delayed report has been lodged after a lapse of more than seven years. Counsel submits that as per statements of all the witnesses the money was given to the complainant Badan Singh. Counsel submits that the petitioner has no concern whatsoever with the alleged incident. Counsel submits that the petitioner has no criminal antecedents and he has already appeared before the Investigating Officer and his interrogation has been done, now his custodial interrogation is

not required, so indulgence of anticipatory bail be granted to the him.

Learned Public Prosecutor opposed the prayer for anticipatory bail.

Heard the learned counsel for the parties and perused the impugned order.

Considering the arguments put forward by the learned counsel for the petitioner and looking to the fact that the petitioner has already appeared before the Investigating Officer and his interrogation has been done and now his custodial interrogation is not required, this Court is of the opinion to grant anticipatory bail to the petitioner under Section 438 Cr.P.C.

Accordingly, the bail application is allowed and it is directed that in the event of arrest of petitioner Karamveer Singh S/o Shri Rajveer Singh in connection with FIR No.95/2021 Police Station Kumher, District Bharatpur the petitioner shall be released on bail; provided he furnishes a personal bond in the sum of Rs.50,000/- along with two sureties of Rs.25,000/- each to the satisfaction of the concerned Investigating Officer/S.H.O. on the following conditions :-

(i). that the petitioner/s shall make himself/herself available for interrogation by a police officer as and when required

¶22

(ii). that the petitioner/s shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer; and

(iii). that the petitioner/s shall not leave India without previous permission of the court.
