It is the story of the prosecution that on 29.01.2022, police team made a raid at the house and agricultural fields of principal accused Vishnu, but somehow, he made his escape good and fled away from the spot. Certain quantity of contraband came to be recovered. After sometime, principal accused Vishnu got apprehended and it is alleged that while in police custody, the principal accused Vishnu had disclosed names of co-accused Surrendra and Ashok, who facilitated the crime with regard to procurement of the contraband. The present applicants-Tulsiram and Ricchapal were neither present at the spot, nor their names have been disclosed by the accused Vishnu. They have been arraigned as an accused in this case merely on the statement of the co-accused, admissibility of which is seriously arguable. Be that as it may, As on date, there is no direct evidence on record so as to show the culpability of the petitioners and they being behind the bars for the last more than one year and conclusion of trial is not a seeming fate.
