The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No.240/2022 registered at Police Station Gegal District Ajmer for the offence under Sections 328, 376, 376 (2) (n), 384 & 450 of IPC.

Heard the arguments advanced by learned counsel for the parties.

Considering the fact that in the FIR dated 03/12/2022, the victim/complainant has herself stated that she was in close proximity of the accused-applicant; that the FIR is filed at a belated stage i.e. after the lapse of a period of 2.5 years from the date of the alleged incident; that no other criminal cases are pending adjudication qua the accused-applicant as on date; that

charge sheet in the instant matter has already been filed and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicant and enlarge him on bail.

Accordingly, the bail application filed under Section 439 Cr.P.C. is allowed.

It is ordered that accused-applicant Ahemad Raja @ Mantri S/o Shri Mohammad Ramjan shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
