Heard learned counsel for the petitioners as well as learned Public Prosecutor and also perused the material on record.

The petitioners have been arrested in FIR No.498/2022 of P.S. Chittorgarh, District Chittorgarh for the offences punishable under Sections 384, 419, 420 and 120-B I.P.C. and under Section 66 D of Information Technology Act, 2008. They have preferred this bail application under Section 439 Cr.P.C.

Learned counsel for the petitioners has submitted that the co-accused persons namely Sirujul Haq, Mohd. Najib, Rohit Parihar and Sanny @ Robin Singh Bhalla have already been enlarged on bail and the offence alleged to have been committed by the petitioner is triable by the Magistrate.

Learned Public Prosecutor has opposed the bail application.

Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioners under Section 439 Cr.P.C.

Accordingly, this bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioners No.1 Jiyanpa Chugho @ Jack S/o Shri Telu Chugho, No.2. David S/o Notham Konyak Critian, No.3 Jainy Thung S/o Shri Malamo Kithon, No.4 Jachhriyh Akka @ Jack S/o Suresh Akka, No.5 Kiran Suba S/o Shri

Raj Bahadur Suba, No.6 Apan Koniyak S/o Shri Jaiwong Koniyak, No.7 Jiri S/o Vipin Naga, No.8 Lithan Angami S/o Shri Vachuthang Angami shall be released on bail in connection with FIR No.498/2022 of P.S. Chittorgarh, District Chittorgarh provided each of them executes a personal bond in a sum of Rs.50,000/with two sound and solvent sureties of Rs.25,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
